Moody ISD Personal Communication Device Policy

In accordance with Texas House Bill 1481, Texas students are prohibited from using personal communication devices while on school property during the regular school day.  The term “Personal Communication Device” includes a telephone, cell phone (such as a smartphone or flip phone), tablet, smartwatch, radio device, paging device, or any other electronic device capable of telecommunication or digital communication.  In compliance with the law, Moody ISD has designated the following method for the storage of a student’s personal communication devices while the student is on district property during the school day:

Moody ISD students who wish to bring a personal communication device onto school property will be issued a small, protective pouch.  A student’s device MUST remain sealed in their assigned pouch during the entire school day.  Each pouch is designed to protect the device, will block all incoming or outgoing wireless communication, and has a velcro enclosure so that devices could be accessed with administrator permission or during an emergency.  Any student who loses or damages a school-issued pouch will be responsible for the cost of replacement.

A student who removes a device from the designated pouch without permission, is in possession of a device that is not stored in accordance with district policy, or uses a device during the school day is subject to disciplinary action in accordance with the Moody ISD Student Code of Conduct.  Please see the following progression of disciplinary consequences related to violations of Moody ISD’s Personal Communication Device Policy:

 

1st offense - The student will receive a warning and the device will be stored in the office for the remainder of the day. The student can pick up the device at the end of the school day. 

2nd offense - The student will receive 1 day of detention and the device will be stored in the office for the remainder of the day. The student can pick up the device at the end of the school day. 

3rd offense - The student will receive 3 days detention and the device will be stored in the office for the remainder of the day. The student's parent/guardian must pick up the device.  

4th offense - The student will receive 1 day of ISS and the device may remain confiscated or may not return to school until the completion of the ISS placement. If the student has their phone while in ISS, an additional discipline consequence may be added. 

5th offense - The student will receive 2 days of ISS and the device may remain confiscated or may not return to school until the completion of the ISS placement. If the student has their phone while in ISS, an additional discipline consequence may be added.  

6th offense/each consecutive offense - The student will receive 3 days of ISS and the device may remain confiscated or may not return to school until the completion of the ISS placement. If the student has their phone while in ISS, an additional discipline consequence may be added.
